These Terms and Conditions (“Terms”) govern your use of Lithos and our website at www.1-north.com. By downloading or using Lithos or our website, you agree to these Terms. If you don’t agree, please don’t use the app or our website. If anything is unclear, feel free to contact us at info@1-north.com before using the app or our website.

1. About Lithos

Lithos is an iPhone and iPad app for geoscientists to collect, integrate, analyse, and interpret earth science field data in an applied GIS environment. Your data is stored locally on your device. You can optionally enable iCloud sync to back up and access your data across your Apple devices using your personal iCloud account.

Lithos is a professional tool designed for geoscientists of all experience levels. It does not contain objectionable content. While users of any age may use Lithos, it is a professional application and is not designed or marketed towards children.

  1. Subscription and payment

Billing

Lithos is available by subscription, purchased through the Apple App Store. All billing, payment processing, and subscription management are handled entirely by Apple. We do not see or store your payment details, card numbers, or billing address.

Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time in your Apple ID account settings.

Refunds

Refund requests must be made directly through Apple. Visit reportaproblem.apple.com for assistance. We are unable to process refunds directly.

Price changes

We may change subscription prices from time to time. Apple will notify you of any price change before it takes effect. Your subscription price will not increase without your prior consent.

3. Your data

Your geological observations, project files, maps, and other field data belong to you. We do not access, store, or process this data on our servers.

  • If you do not use iCloud sync, your data lives only on your device. If you delete the app, that data is deleted with it. Back up regularly.

  • If you enable iCloud sync, your data is stored in your personal iCloud account. It remains there if you delete the app, and is governed by Apple’s iCloud Terms of Service.

We strongly recommend maintaining your own backups of any important field data, regardless of whether you use iCloud sync.

4. iCloud / CloudKit sync

The optional iCloud sync feature uses Apple’s CloudKit. If you enable it, your data is subject to Apple’s iCloud Terms of Service and Privacy Policy, not ours. You are responsible for your own iCloud storage and account. 1°North cannot access your iCloud data.

5. Third-party services

Mapbox

Lithos uses Mapbox to display maps. By using the map features, you acknowledge that map tile requests are sent from your device directly to Mapbox’s servers, and that your use of map features is subject to Mapbox’s terms of service and privacy policy at mapbox.com/legal.

Apple

Your subscription relationship — including billing, family sharing, and refunds — is with Apple. Apple’s Media Services Terms and Conditions and Privacy Policy govern that relationship. We are not responsible for Apple’s services or how Apple handles your data.

6. Intellectual property

Lithos and all content within it — including the software, design, icons, maps (excluding Mapbox tiles), and documentation — are owned by 1°North or our licensors, and are protected by intellectual property laws.

We grant you a personal, non-transferable, non-exclusive, revocable licence to use Lithos on your Apple devices for your own professional or personal purposes, subject to these Terms and Apple’s standard End User Licence Agreement (EULA).

You may not:

  • Copy, modify, adapt, or distribute the app or any part of it

  • Reverse-engineer, decompile, or attempt to extract the source code

  • Use the app to build a competing product or service

  • Remove or obscure any copyright or proprietary notices

  • Sublicense or resell access to the app

7. Acceptable use

You agree to use Lithos lawfully and responsibly. You must not use it to:

  • Violate any applicable law or regulation

  • Infringe anyone’s intellectual property or other rights

  • Upload or transmit malicious software of any kind

  • Attempt to circumvent, disable, or interfere with the security or functionality of the app

  • Harvest or collect data about other users

8. Disclaimer of warranties

Lithos is provided “as is” and “as available” without warranties of any kind, whether express or implied. We make no guarantee that the app will be error-free, uninterrupted, or that it will meet your specific requirements.

Lithos is a professional tool — the accuracy of data you record is your responsibility. Always maintain your own backups. We are not liable for loss or corruption of geological data, project files, or any other information.

Nothing in this section excludes any statutory guarantee or warranty that cannot be excluded under applicable consumer protection law.

9. Limitation of liability

To the fullest extent permitted by applicable law, 1°North’s total liability to you for any claim arising from these Terms or your use of Lithos is limited to the amount you paid us for your subscription in the three months preceding the event giving rise to the claim.

We are not liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of data, loss of profits, or loss of business opportunities.

Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited under applicable law.

For Australian users: Our services come with guarantees under the Australian Consumer Law that cannot be excluded. You are entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage.

10. Changes to these Terms

We may update these Terms from time to time. We’ll notify you of material changes via the app or our website. Your continued use of Lithos after changes are posted means you accept the updated Terms.

We may also add, change, or discontinue features with reasonable notice. If we discontinue Lithos entirely, we will notify you and your subscription will be handled through Apple’s standard processes.

11. Termination

You may stop using Lithos at any time by deleting the app and cancelling your subscription through Apple.

We may suspend or terminate your access to Lithos if you materially breach these Terms, with notice where reasonably practicable. On termination, your licence to use the app ends immediately. Your data stored locally or in iCloud is not affected.

12. Governing law and disputes

These Terms are governed by the laws of Singapore. Any dispute that we cannot resolve informally will be subject to the non-exclusive jurisdiction of the courts of Singapore.

EU / EEA users: If you are a consumer in the EU or EEA, you also have rights under the consumer protection laws of your country of residence, which these Terms do not override.

Australian users: Your rights under the Australian Consumer Law apply and cannot be excluded by these Terms.

13. General

These Terms constitute the entire agreement between you and 1°North regarding your use of Lithos, and supersede any prior agreements.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.

Our failure to enforce any part of these Terms does not constitute a waiver of our rights.

You may not transfer your rights or obligations under these Terms to anyone else.
